General terms and conditions of online ticket sales for museums and monuments managed by Culturespaces
PREAMBLE
All ticket orders placed on the www.vivaticket.com website are governed exclusively by the present terms and conditions of sale, which we recommend you read carefully.
Placing an order implies prior consultation of these terms and conditions of sale and full and irrevocable acceptance thereof.
ARTICLE 1 - ACCEPTANCE OF THESE TERMS AND CONDITIONS OF SALE
The purpose of these general terms and conditions of sale is to define the rights and obligations of the parties in the context of ticket sales via the www.vivaticket.com website.
The Customer acknowledges having read these general terms and conditions of sale prior to validating their order. Any validation of the order implies acceptance of the general conditions without exception.
Vivaticket.com reserves the right to adapt or modify these terms and conditions of sale at any time. In the event of modification, the general conditions of sale in effect on the day the order is placed will apply to each order.
ARTICLE 2 - TICKETS FOR SALE
2.1 What services tickets entitle the holder to
Tickets entitle the holder to access the temporary exhibitions and/or permanent collections of the museums and monuments managed by Culturespaces for a given period.
2.2 Period of validity of issued tickets
Each issued ticket is valid only for the time indicated on the ticket.
2.3 Ticket availability
When placing an order, the Customer is informed in real time of the availability of the desired tickets.
ARTICLE 3 - PRICES OF SERVICES AND ORDER PRICES
The website proposes several rates according to the type of visit in question and the age or status of the beneficiary of the admission right.
Tour prices are those displayed on the different websites[MK1] managed by Culturespaces at the time the order is placed. These prices do not include any management fees that may be invoiced in addition on the day the order is placed.
The total price when the order is validated is the final price, including all taxes and management fees. The price is indicated in the order confirmation e-mail and in the invoice.
Tour prices and the total price of the order are indicated in euros.
Culturespaces and Vivaticket.com reserve the right to modify their prices at any time.
ARTICLE 4 – ORDER
The online ordering procedure consists of the following steps:
1/ The Customer selects the ticket(s) of their choice
For each ticket, the Customer chooses, if applicable, the day and time of the visit, and finally the number of entries corresponding to a given price.
2/ The Customer creates a Customer account or logs on to their customer account by entering a login and password
The creation of a customer account implies the transmission of the information required to process the future order: first and last name, address, telephone number, e-mail address and date of birth.
3/ The order summary is displayed
Once the Customer has checked their order and read the present terms and conditions of sale, they can pay for their order online, by entering their bank details (card number and expiry date) and clicking on the payment button.
In the event of refusal by the applicable payment center, the order is automatically cancelled.
Payment of the order by the Customer constitutes irrevocable acceptance of the order, which cannot be challenged.
4/ The Customer receives an order confirmation e-mail
ARTICLE 5 - PAYMENT TERMS AND CONDITIONS
5.1 Payment terms
Payment for tickets by the Customer is made exclusively in euros and by bank card. The following cards are accepted: CARTE BLEUE, VISA, EUROCARD and MASTERCARD.
5.2 Payment transactions
The Customer's bank account is debited for the amount of the order as soon as the transaction has been accepted by the payment center.
In the event of refusal by the payment center, the order is automatically cancelled.
5.3 Invoice
Once the transaction has been completed, the Customer can obtain an invoice by logging on to their Customer account.
5.4 Payment security
Payment by bank card is made via the secure bank servers of our partner (PAYBOX). This means that no banking information concerning you is transmitted via the Vivaticket.com site. Payment by bank card is therefore perfectly secure; your order will be registered and validated as soon as payment has been accepted by the bank you have chosen.
Your credit card details are encrypted using SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the Internet. Payment is made directly to the bank.
Vivaticket.com has no access to these details and does not store them on its servers. That's why you'll be asked for them again each time you make a new transaction on our website.
ARTICLE 6 - ORDER CONFIRMATION
6.1 As soon as the payment center has confirmed payment of the order, the Customer will receive an e-mail confirming the order.
6.2 The confirmation e-mail acknowledges receipt of the order and contains the following information:
- the date and time of the order,
- the essential specifications of the ticket(s) sold,
- the unique order number,
- the total amount of the order.
ARTICLE 7 - TERMS AND CONDITIONS OF TICKET DELIVERY
The ordered ticket(s) is/are, at the Customer's request:
- either downloadable by the Customer from their Customer account, in PDF format and printable on A4 paper using a printer connected to a computer;
Please note: the E-ticket requires a printer capable of printing it on a blank sheet of A4 paper. The customer may print the ticket in either black and white or color.
- or downloaded by the customer as an image onto their mobile phone from their customer account.
ARTICLE 8 - CONDITIONS OF USE OF TICKETS
All TICKETS are systematically checked at the entrance to the site. This check consists of scanning the barcode on the ticket (digital code).
Only tickets with perfectly legible barcodes and labels will be accepted.
It is the Customer's responsibility to ensure on the day of the visit that:
- the ticket is printed in color or black and white on a blank A4 sheet, with a barcode and clearly legible details (type of visit, period of validity of the ticket, surname and first name of the ticket holder);
- the ticket includes a barcode and clearly legible information (type of visit, period of validity, surname and first name of the ticket holder).
Partially printed, soiled, damaged or illegible tickets will not be accepted.
Tickets with a reduced rate must be presented with proof of the reduced rate.
Only the following valid documents will be accepted: identity card, or for children, family record book; unemployment benefit certificate less than 6 months old; "large family" card.
The ticket is only valid for the visit and time period indicated on it. The ticket must be kept until the end of the visit.
CULTURESPACES RESERVES THE RIGHT TO REFUSE ENTRY TO THE VENUE IF A TICKET IS PRESENTED IN BREACH OF ANY OF THE ABOVE CONDITIONS.
ARTICLE 9 - FRAUDULENT USE - LOSS - THEFT OF TICKETS
9.1 Fraudulent use of tickets
It is strictly forbidden to duplicate, duplicate or counterfeit a ticket in any way whatsoever. Duplicating a ticket is prohibited and will not provide any advantages.
Any person who illegally duplicates a ticket and/or uses a counterfeit ticket is liable to prosecution.
Culturespaces will refuse access to the venue to any bearer of a ticket with a barcode that has already been scanned.
ARTICLE 10 - CONDITIONS FOR TICKET REFUNDS AND EXCHANGES
10.1 In accordance with article L 121-20-4 of the French Consumer Code, the purchase of a ticket is not subject to the legal right of withdrawal.
Any ticket issued may not be exchanged or refunded, except in the event of a cancellation by Culturespaces of the service to which the ticket entitles the holder to under the conditions defined in Article 11.2.
Cancellation is however excluded in the event of force majeure as defined in Article 12.
10.2 In the event of cancellation by Culturespaces of the service shown on the ticket, Customer Service will contact you as soon as possible by e-mail or SMS to inform you and will offer you:
- either, if possible, with the same ticket, the rescheduling of the relevant service to a different day and/or time;
- or a refund of the ticket in question, specifying the terms and conditions.
10.3 All requests for ticket exchanges and/or refunds must be made to the Customer Service department, whose contact details can be found on the www.culturespaces.com website.
ARTICLE 11 - FORCE MAJEURE
Culturespaces shall not be held liable for any inability to perform due to force majeure. The following in particular are considered to be cases of force majeure by the jurisprudence of French courts and tribunals: total or partial strikes inside or outside Culturespaces, blockage of means of transport or supply for any reason whatsoever, governmental or legal restrictions.
ARTICLE 12 - PROOF, STORAGE AND ARCHIVING
The computerized registers, kept in the computer systems of Culturespaces or any service provider of the latter, under reasonable conditions of security, will be considered as proof of the sales contract, its date, orders and payments made.
Orders and invoices will be archived on a reliable and durable medium in such a way as to correspond to a faithful copy, in accordance with the article of the French Civil Code.
ARTICLE 13 - PROTECTION OF PERSONAL DATA
When an order is placed, the Customer is asked to provide personal data (first and last name, address, e-mail address, telephone number and date of birth).
This data is required to process and monitor the order, and is also used in the event of a postponement or cancellation of the activity to which the ticket gives access.
The personal data collected is processed by the company VivaTicket, in the name and on behalf of Culturespaces, in compliance with the legal provisions relating to the protection of personal data set out in the French Data Protection Act no. 78-17 of January 6, 1978. Customers have the right to access, modify, rectify and delete their personal data at any time. They may exercise this right by writing to our Customer Service department at Culturespaces - Service Clients Culturespaces - 153 boulevard Haussmann 75008 Paris or via the online form.
ARTICLE 14 - ENTIRETY OF THE GENERAL TERMS AND CONDITIONS
The Customer and Culturespaces acknowledge that these general terms and conditions of sale constitute the entire agreement between them.
If, for any reason whatsoever, any clause of these general terms and conditions should be declared inapplicable, it shall be deemed unwritten without invalidating these general terms and conditions or altering the other provisions of the general terms and conditions.
ARTICLE 15 - SETTLEMENT OF DISPUTES
The present terms and conditions of sale are governed by French law.
Any claim must be made in an appropriate manner, allowing proof of the disputed fact to be preserved, specifying the details of your dissatisfaction as well as your order number. All complaints must be sent to Culturespaces by post to the following address:
